General Terms and Conditions

The General Terms and Conditions (“GTC”) contain the general terms and conditions for the use of the webshop operated by Pixano. (HUNGARY, 8411 VESZPRÉM, LŐDOMB STREET 11. floor: 1 door: 3. tax number: 90520253-1-39) as a service provider (“Service Provider”). Please use our services only if you agree with all of them and consider them binding on you. This document will not be filed, it will be concluded exclusively in electronic form (it does not qualify as a written contract), and it does not refer to a code of conduct.

Basic provisions

1.1. Hungarian law shall govern any issues not regulated in these Regulations and the interpretation of these Regulations, with particular regard to the relevant provisions of Act V of 2013 on the Civil Code (“Civil Code”) and Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society. The mandatory provisions of the relevant laws shall apply to the parties without any separate stipulation.

1.2. Scope, amendment of the GTC.

1.3. The webshop, as a copyrighted work, is protected by copyright. The Service Provider reserves all rights to the website, any part of it and the content appearing on it, as well as the distribution of the website. It is prohibited to download, electronically store, process and sell the content appearing on the website or any part thereof without the written consent of the Service Provider.

1.4. Availability: We accept orders 24/7, and in each case we confirm receipt of the order by e-mail.

1.5. The privacy policy is available at the bottom of the website.


Range of products and services available for purchase

1.6. The displayed products can only be purchased online. The prices shown include VAT. The price does not include the home delivery fee. The packaging fee is borne by the Service Provider.

1.7. In the webshop, the Service Provider displays the product name and description in detail, and displays photos of the products. The images displayed on the product data sheet may differ from the actual product, and in some cases they are used as illustrations.

1.8. If a promotional price is introduced, the Service Provider will fully inform Users about the duration of the promotion.


Order process

1.9. Submitting the order: If you are satisfied with the products in your cart, have checked the total amount and have decided to purchase them, simply click on the “Checkout” button. Then enter your details for the purchase. If you agree with the content of the order and accept the Terms of Purchase (i.e. these GTC), click on the “Place Order” button to submit your order.

1.9.1. Order cancellation, preview and corrections
The Customer is only entitled to cancel their order until the Service Provider has sent them the first, individually created preview image .

After sending the first preview image, the order cannot be canceled . If the Customer does not send feedback on the preview image, the Service Provider will print and send the product based on the available preview.

The Customer may request an unlimited number of corrections, modifications or redraws to the preview image, free of charge, until the production of the product begins.

Content requirements for uploaded images and order cancellation


For products that can be ordered by uploading images, the Customer may only upload images that are legal, do not violate public morality, and comply with today's social norms .


It is prohibited to upload illegal or 18+ content (pornographic, erotic) images. If such content is detected, the Service Provider will automatically cancel the order and notify the Customer.

1.10. The service provider web store is obliged to immediately confirm the receipt of the user's order to the user electronically.

The information provided on the website does not constitute an offer to conclude a contract by the Seller. In the case of orders subject to these GTC, the Consumer is considered the offeror, and the contract is concluded upon the acceptance by the Seller of the offer made by the Consumer via the website in accordance with the provisions of these GTC. By pressing the “Order” button, the User expressly acknowledges that his offer shall be deemed to have been made and that his statement – ​​if confirmed by the Seller in accordance with these GTC – entails a payment obligation.


1.11. Payment options, delivery methods: The Consumer can pay for the purchase with a bank card or request a cash on delivery option. After that, the product will be delivered using the delivery method selected by the Buyer.

Bank card payment:

The bank card details are not transferred to ourmoments.hu, the transaction is 100% carried out through Stripe's secure system. In case of successful payment, the customer will be taken to the ourmoments.hu “thank you page”, then will receive a “Paid” mark, and the product(s) will be shipped.

Delivery:

The package will be delivered by GLS Courier Service to the specified address within 20 working days from the date of order.

Delivery takes place on weekdays and during working hours, between 8 a.m. and 5 p.m. If the courier does not find a customer at the specified address, he will leave a notification and try delivery again the next day.


Order processing and fulfillment

1.12. General delivery deadline, within 20 working days from confirmation. If the Service Provider is unable to fulfill the order within 20 working days, it is obliged to notify the Consumer by phone or e-mail.

1.13. If the Service Provider does not fulfill its obligations under the contract because the product specified in the contract is not available, it is obliged to inform the Consumer immediately and to refund the amount paid by the Consumer immediately, but no later than within thirty days.


Right of withdrawal

The products sold in the Operator's webshop are made to order, which are manufactured and delivered in the form created by the Customer on the website. Due to the uniqueness of the products, which are designed according to the Customer's express needs, the production of the product begins after the order is confirmed.

Please note that in the case of products manufactured based on individual requirements, pursuant to Section 29 (1) c) of Government Decree 45/2014. (II. 26.), the Customer is not entitled to the right of withdrawal, since the individual product is a non-prefabricated item that was manufactured based on the instructions or express request of the Customer. Accordingly, the return of ordered individual products and the refund of the purchase price are not possible.

We recommend that you carefully check the information provided and the intended product before ordering the product, as it is not possible to modify or cancel the order once the production process has begun.

The Consumer does not have the right of withdrawal in the case of a non-prefabricated product that was produced based on the Consumer's instructions or at their express request, or in the case of a product that was clearly tailored to the Consumer.

Refund rules in case of damage during delivery or manufacturing defectIf the product is damaged during delivery or arrives with a manufacturing defect, the customer has the option to request a refund instead of a replacement product. The refund is made in the following way:1.In case of prepayment by bank cardIf the customer paid for their order in advance by bank card, the refund is automatically made via the STRIPE bank card payment service provider, to the bank card linked to the customer's original transaction.2.In case of payment by cash on deliveryIf the customer paid for the order by cash on delivery, the refund can only be made by bank transfer to the bank account number in IBAN format provided by the customer. The customer must provide the IBAN account number to our customer service in writing.

  1. Complaint handling procedure:

2.1. The aim of our webshop is to fulfill all orders in good quality and to the full satisfaction of the customer. If the Consumer has any complaints regarding the contract or its performance, they can submit their complaints by phone, e-mail or letter.

2.2. The Service Provider shall immediately examine the oral complaint and remedy it as necessary. If the customer does not agree with the handling of the complaint or if immediate investigation of the complaint is not possible, the Service Provider shall immediately record the complaint and its position on it and shall provide a copy thereof to the customer.

2.3. The Service Provider shall respond to the written complaint in writing within 30 days. It shall justify its position rejecting the complaint. The Service Provider shall keep the minutes of the complaint and a copy of the response for five years and shall present them to the supervisory authorities upon their request.

2.7. The conciliation body is responsible for the out-of-court settlement of consumer disputes. The conciliation body is responsible for attempting to reach an agreement between the parties for the purpose of settling the consumer dispute; if this fails, it shall make a decision on the matter in order to ensure the simple, fast, efficient and cost-effective enforcement of consumer rights. The conciliation body shall, at the request of the consumer or the Service Provider, provide advice on the rights and obligations of the consumer.

2.8. In the event of a cross-border consumer dispute related to an online purchase or service contract, the conciliation body operating under the Budapest Chamber of Commerce and Industry is solely competent for the procedure.

2.9. In the event of a complaint, the Consumer may use the EU Online Dispute Resolution Platform. Using the platform requires a simple registration in the European Commission system, by clicking here . After that, after logging in, the Consumer may submit his complaint via the online website, the address of which is: http://ec.europa.eu/odr

2.10. The service provider is obliged to cooperate in the conciliation body procedure. In this context, it is obliged to send its response to the conciliation body and to ensure the participation of the person authorized to establish a settlement at the hearing. If the registered office or business premises of the enterprise are not registered in the county of the chamber operating the territorially competent conciliation body, the enterprise's obligation to cooperate extends to offering the consumer the possibility of concluding a written settlement in accordance with his/her needs.
